Acceptance of these terms
By creating an account, accessing, or using TrackNotion, you agree to these Terms of Service and any policies referenced here. If you do not agree, you may not use the service. If you are using TrackNotion on behalf of a business, you represent that you have authority to bind that business to these terms.
Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep your account details current. You can manage user access through multi-user permissions, and you are responsible for the actions of users you invite to your account.
Acceptable use
You agree to use TrackNotion only for lawful purposes and in compliance with all applicable laws, including those governing call recording and consumer privacy. You may not use the service to record calls without any consent required under applicable law, to process data you do not have the right to process, or to abuse, disrupt, or reverse-engineer the platform. We may suspend or terminate access for violations of these terms.
Call tracking and number usage
TrackNotion provides tracking numbers, dynamic number insertion, recording, transcription, and related features to help you attribute and analyze calls. You are responsible for the content of your calls and for ensuring your use of tracking numbers complies with carriers, regulators, and applicable law. Tracking numbers are licensed to you for use with the service and remain subject to our management of the underlying telephony infrastructure.
Your data
You retain ownership of the call recordings, transcripts, caller data, and other content you process through TrackNotion. You grant us the rights necessary to operate, secure, and improve the service, including processing your data to deliver the features you request. You are responsible for ensuring you have the rights to the data you upload or generate through the service.
Billing and subscriptions
Paid plans are billed on a recurring basis according to the pricing and terms shown on our pricing page. You authorize us to charge your payment method for the fees associated with your plan, including overages for tracking numbers and minutes where applicable. Fees are generally non-refundable except where required by law. You can change or cancel your plan at any time; cancellations take effect at the end of your current billing period.
Free trial
We may offer a free trial for a limited period. Trial access is subject to these terms and may be limited by usage, features, or duration. We may modify or end trial offerings at any time.
Service availability
We work to keep TrackNotion reliable but do not guarantee uninterrupted or error-free service. We may update, change, or discontinue features, and we are not liable for downtime, outages, or issues caused by factors outside our reasonable control, including telephony carriers and third-party providers.
Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your specific requirements or that AI transcription, sentiment, or grading results will be accurate or error-free.
Limitation of liability
To the fullest extent permitted by law, TrackNotion and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost data, or business interruption arising from your use of the service, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising from the service is limited to the fees you paid us in the twelve months preceding the claim.
Termination
You may cancel your account at any time. We may suspend or terminate your access if you violate these terms, fail to pay fees, or pose a risk to the service or other users. Upon termination, your right to use the service ends, and we may delete your data according to our retention practices unless law requires otherwise.
Changes to these terms
We may update these Terms of Service from time to time. When we make material changes, we will post the updated terms here and update the effective date. Continued use of the service after changes take effect means you accept the updated terms.
